Terms and Conditions

PROTECTION FENCE COMPANY TERMS AND CONDITIONS

PFC = Protection Fence Company
*(Both parties are Protection Fence Company and Customer/Customers)​
ESTIMATES

  1. Estimates      are not contracts and do not guarantee a position on our schedule.
  2. Drawings      are not to scale.
  3. One      free standard estimate either verbal or an onsite inspection within our      installation area and a verbal or emailed price. Any additional estimates      whether verbal, written or onsite will incur a fee payable before receipt      of the estimate and determined by PFC.
  4. Insurance      estimates and detailed estimates are $100 each payable to PFC prior to       receipt of the estimate and/or the onsite inspection within our      installation area. Includes one written estimate. Revisions to the written      estimate are $30 per occurrence, payable before receipt of the revised      written estimate.
  5. Prices on estimates and unsigned      contracts are subject to change without notice.
  6. PFC’s      standard minimum is $750.00 plus cost of material and any applicable      taxes.
  7. Decrease      in units results in an increase in per unit price.
  8. Union,      state, and prevailing wages not included.
  9. No      tax on capital improvements.

​CONTRACTS

  1. Customer      is responsible for notifying PFC of any errors in this agreement within 48      hours of signing.
  2. Please      inform us of any misprints PRIOR to signing.
  3. Drawings      are not to scale.
  4. Contracts      with no deposit (unless otherwise agreed upon) are NOT valid.
  5. Prices      only valid if entire job is done together.
  6. Prices are subject to change after (two) 2 months on signed      contracts. We will notify you when this happens.
  7. The      signee/customer gives PFC the authority to remove material from site (we      may cut posts at ground level and leave stubs and concrete in the ground)      and forfeits a 40% fee of the total contract price to PFC if payment is      not made upon completion as agreed upon.
  8. This      contract cannot be changed unless both parties agree to all changes.
  9. One      revision is complementary. Additional revisions will incur additional      fees. Previous contract void, unless otherwise specified.
  10. Payment      in full constitutes complete satisfaction.
  11. PFC      reserves the right to choose who we do business with.
  12. Customer      has read this entire contract and has 48 hours from when PFC receives it      to CANCEL.
  13. Deposits      are not refundable if preparing/manufacturing and/or ordering of material      has begun. Deposits from voided contracts cannot be applied.
  14. Customer      is responsible for material, labor and storage costs (costs determined by      PFC) if customer chooses to cancel or delay the contract.
  15. If customer      delays the install and/or pick-up of DIY material, storage fees will be incurred.      PFC can void the contract if the customer continues to delay.
  16. Contract      with total less than $750 requires payment in full as deposit.
  17. Specialty      items will require a larger deposit.

​PAYMENT, INTEREST AND FEES

  1. All      balances past due are subject to 1½% per month carrying charges and fees      compounded daily, plus $40.00 late pay fee each occasion. $50.00 return check      fee.
  2. WE DO      NOT ACCEPT ANY CREDIT/DEBIT OR GIFT CARDS. ALL PAYMENTS ARE PAYABLE ONLY      BY CASH, CHECK, MONEY ORDER OR BANK CHECK.
  3. Storage      fees: starts at $40 per day and increases with volume. Fees begin one (1)      week after PFC notifies customer.
  4. PFC is      not responsible for any fines/fees etc resulting from violations etc.
  5. Shortened      panels/sections will be charged the full section length price.
  6. Jobs      that require ordering material, may have freight/surcharges due to      quantities.
  7. Changing      location of holes already dug, poles and/or sections or gates, etc already      installed results in an additional fee.
  8. Changes      to quantities, style, layout, etc, once manufacturing has begun will incur      extra fees.
  9. No      partial payments.

​SCHEDULE

  1. Placement      on PFC schedule occurs when PFC receives a valid signed contract with      deposit.
  2. Schedule      is determined by the order of received contracts.
  3. PFC’s      schedule is affected by weather, delays in jobs signed prior, employee      illness, emergencies, product availability, customer availability/readiness,      other circumstances beyond the control of PFC.
  4. Customer      responsible for contacting PFC for approximate schedule updates.
  5. Custom      fences may result in a longer wait period.

​CUSTOMER RESPONSIBILITIES

  1. Customer      is responsible for applying and acquiring permits and paying all necessary      fees and adhering to all codes.
  2. Customer      is responsible for any fines and/or fees and agrees to compensate PFC if      any should occur.
  3. Customer      must confirm receipt of contract and deposit.
  4. Customer      has the authority and is responsible for indicating or having someone      indicate the exact location of any and all above ground and underground      obstructions prior to commencement of installation as PFC is not      responsible for any damages.
  5. Customer      is responsible for indicating fence and property line locations. PFC is      not responsible for any resulting issues, discrepancies, disputes, etc.      with property lines.
  6. Customer      must clear a large enough area for installation (ask PFC for further      details).
  7. Customer      is responsible to fill gaps between the ground and the bottom of the      fence. Arrangements must be made prior to installation, especially for      fences intended to contain dogs.
  8. It is      the customer’s responsibility to maintain what is installed by PFC.
  9. Customer      is responsible for informing PFC of any and all applicable codes in their      municipality.

​INSTALLATION TECHNIQUES

  1. PFC      has a standard installation technique, please ask about this.
    • Example:        Fences cannot follow all terrain which may result in gaps under the       fence

  1. Good      side of fence will typically face away from customer and rails will face      in towards customer.

MATERIALS

  1. PFC      has standard manufacturing techniques, please ask about this.
  2. Fence      material is not meant to be used as porch/deck or stairway railing and may      not pass code.
  3. Wood fences      typically have mill-run full 4”x4” posts, mill-run pickets (before      planing), back rails are mill-run nominal 2x3 or 2x4, unless otherwise      specified.
  4. Nails      are hot-dipped galvanized, ring shank.
  5. Custom      wood styles are made from uncoated white cedar wood, unless otherwise      specified. Wood material has imperfections, such as knots, bark, stress      cracks etc.
  6. Cuts,      notches, routers, mortises, etc vary in size, shape and location and are      not identical.
  7. Rustic      (West Virginia) split rail (post and rail), is NOT made of cedar and           cannot be installed to look smooth and      square. The material is rough hewn and disproportioned.
  8. Wood      putty is used to fill certain areas of wood materials at the discretion of      PFC. There may be little to many areas filled with wood putty.

REPAIRS

  1. Dismantling      older fences may damage existing posts/sections and incur extra fees.
  2. No      Warranty on repairs.

​DO-IT-YOURSELF

  1. PFC      IS NOT RESPONSIBLE FOR ERRORS, OMISSIONS AND OR CUSTOMER           CHANGES/CANCELLATIONS. PFC CANNOT PROCESS      YOUR ORDER WITHOUT A SIGNED      CONTRACT AND      DEPOSIT.
  2. See      PAYMENT, INTEREST and FEES.
  3. See      MATERIALS.
  4. See      CUSTOMER RESPONSIBILITIES.
  5. Do-it-yourself      payments by CHECK require ID verification showing a valid address.
  6. Certain      items, including custom items, are non-returnable and non-refundable.
  7. Items      that are returned must be inspected by a PFC representative before a      refund is issued.
  8. No      refund of delivery charges.
  9. Delivery      fee will be charged for picking up returned items.
  10. Standard      delivery fees based on ROUND TRIP mileage: $50 for 0-10 miles, $75 for      11-25 miles, $100 for 25-35 miles. Ask about further rates for unloading.      Tolls are additional.
  11. Delivery      will not be made unless customer is present to receive material and remit      payment in full.
  12. PFC      is NOT responsible for installation
  13. Balances      are due before delivery or pickup.

​WARRANTY

  1. New      installations are guaranteed against faulty workmanship for one year from      date of installation, under normal conditions.
  2. No      warranty on material not supplied by PFC.
  3. No      warranty on repairs.
  4. No      warranty on Do-it-Yourself or material sales.
  5. Warranty      is void if contract is not paid in full. No warranty claims unless paid in      full.
  6. Certain      conditions affect fence longevity, please ask about this.
